80's Workout Double Dutch Party

RELEASE OF LIABILITY 

 

In consideration of being allowed to participate in any way in the Double Dutch Aerobics program, its related events and activities, I, the undersigned, acknowledge, appreciate, and agree that:

 

1. The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death, and while particular skills, equipment, and personal discipline may reduce this risk, the risk of serious injury does exist; and,

 

2. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASES or others, and assume full responsibility for my participation; and,

 

3. I willingly agree to comply with the stated and customary terms and conditions for participation. If, however, I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the Company immediately; and,

 

4. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS THE Double Dutch Aerobics, their officers, officials, agents and/or employees, other participants, sponsoring agencies, sponsors, advertisers, and, if applicable, owners and lessors of premises used for the activity ("Releasees"), WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

 

5. WEBSITE AND SOCIAL MEDIA RELEASE FORM I, the undersigned, do hereby grant permission to Double Dutch Aerobics Chicago to post my story, photo or other items, hereinafter referred to as “Materials,” I submit to and for Double Dutch Aerobics website, Twitter account, Tik Tok, Instagram and Facebook and any other media accounts for any legal use including but not limited to publicity, copyright purposes, illustration, advertising and web content. I hereby release Double Dutch Aerobics Chicago your representatives, employees, managers, members, officers, parent companies, subsidiaries, directors and coaches, from all claims and demands arising out of or in connection with any use of said “Materials”, including without limitation, all claims for invasion of privacy, infringement of my right of publicity, defamation and any other personal and/or property rights. I acknowledge and agree that no sums whatsoever will be due to me as a result of the use and/or exploitation of the “Materials” or any rights therein. I understand that my image may be edited, copied, exhibited, published or distributed and waive the right to inspect or approve the finished product wherein my likeness appears. Additionally, I waive any right to royalties or other compensation arising or related to the use of my image or recording.

 

6. All items are non-refundable. 

 

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY PURCHASING MY TICKET(S) FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.
